Notices, takedowns and who runs this site

japstein hosts content written by its members. This page explains how to tell us about content that should not be here, and what happens next.

Operator

This forum is operated by japstein.com, established in the Netherlands. Legal notices: legal@japstein.com. Privacy matters: privacy@japstein.com.

What you can report

  • Illegal content: anything whose publication is unlawful under EU or Dutch law, including material that exploits minors, incitement, and content ordered removed by a court.
  • Defamation: a statement of fact about you (or your client) that is false and damaging, presented as true.
  • Personal data and doxxing: your home address, phone number, email address, identification numbers, or details that identify you as a private individual connected to the case without your consent.
  • Copyright: your work reproduced beyond what quotation for discussion allows.

For anything less formal (rule breaches, spam, hostility) use the “Report” link under the post. It reaches the moderators directly.

How to send a notice

Email legal@japstein.com with the subject “Notice”. To be actionable a notice needs:

  1. The exact URL of the thread or reply (each reply has a numbered link, e.g. “#4”).
  2. Which passage you object to, quoted.
  3. Why it is illegal, defamatory or a privacy breach, with enough detail for us to assess it. A statement of the relevant law is welcome but not required.
  4. Your name and a contact address. If you act for someone else, say so. Anonymous notices are considered but may be harder to act on.
  5. A statement that the information in the notice is accurate and that you believe in good faith that the content should be removed.

Do not include personal data that is not already in the disputed content; the address you write to is read by people.

What happens next

  • We acknowledge receipt within 48 hours.
  • Urgent categories (personal data of private individuals, threats, material involving minors) are acted on within 24 hours, usually by hiding the content immediately while it is assessed.
  • Other notices are decided within 7 days. We may ask the author for a response. Where a claim is plausible but unresolved, the content stays hidden while we decide.
  • You receive a reasoned decision by email. So does the author of the content, without your contact details.
  • Either side can ask for the decision to be reconsidered, once, by replying to the decision within 14 days with new arguments or evidence.

Removed content is replaced by a “removed by moderation” placeholder and is no longer shown to readers or search engines. We keep a copy for the time needed to handle disputes or legal obligations, then delete it.

Misuse of notices

Notices that are manifestly unfounded, repeated after a reasoned refusal, or used to suppress accurate reporting of the public record may be declined without further review. Under the Digital Services Act we may suspend the processing of notices from senders who frequently submit manifestly unfounded ones.

Court orders and authorities

Orders from courts and requests from competent authorities in the EU are processed as required by law. We only hand over member data (which is limited to the account id, display name and posts; see the privacy statement) when legally obliged to.

Not legal advice

Nothing on this forum, including this page, is legal advice. Members write in their own name; the operator does not endorse or verify posts before publication but moderates them after.
